By this Chamber Order the Applicant seeks permission to serve the citation upon ALL CONCERNED and Vilas Vitthal Shinde, Son of the deceased, by way of substituted service as per schedule annexed to the Chamber Order.

Perused the schedule. The Applicant applies for publication of citation in two newspapers viz. "Free Press Journal" in English Language and in "Nav Shakti" in vernacular language i.e. Marathi.

Perused the affidavit in support. The Applicant has stated in the affidavit in support that, the whereabouts of Vilas Vitthal Shinde is not known to the Applicant. It is further stated that, the Applicant had made an extensive enquiry about Vilas Vitthal Shinde with friends and relatives and also on social media apps, but his whereabouts are not known. The Applicant, therefore, requested to permit him to publish the citation in two newspapers viz. "Free Press Journal" in English Language and in "Nav Shakti" in vernacular language i.e. Marathi having circulation in Mumbai, by way of substituted service upon ALL CONCERNED and Vilas Vitthal Shinde.

Heard. Ld. Advocate for the Applicant submits that, the whereabouts of Vilas Vitthal Shinde, son of the deceased and his legal heirs are not known to the Applicant. He further submits that, the Applicant had made an extensive enquiry about Vilas Vitthal Shinde and his legal heirs with friends and relatives and also on social media apps, but their whereabouts are not known. He, therefore, prays that the Chamber Order be allowed. 5.

Perused para 8 of the Petition. For the reasons mentioned in the affidavit in support the Chamber Order is allowed and the same is signed separately. Applicant to publish the citation in two newspapers viz. "Free Press Journal" in English Language and in "Nav Shakti" in vernacular language i.e. Marathi widely circulated in Mumbai, by way of substituted service upon ALL CONCERNED and Vilas Vitthal Shinde within four weeks from the date of uploading this Order. Applicant to file the affidavit of publication once the citation is published within two weeks thereafter.
