By this Chamber Order the Applicant seeks permission to serve the citation upon Gaurav Ghidiyal, Son of the deceased, by way of substituted service as per schedule annexed to the Chamber Order.

Perused the schedule. The Applicant applies for publication of citation in two newspapers viz. "Free Press Journal" in English Language and in "Navbharat" in vernacular language i.e. Hindi.

Perused the affidavit in support and additional affidavit. The Applicant has stated in the affidavit in support that, the Citation alongwith true copy of Petition sent for service through the Office of the Sheriff of Bombay was returned back to the Office of the Sheriff alongwith the remark "Left" on 11th September 2025. It is further stated that, the Applicant does not have any information about the whereabouts of Gaurav Ghildiyal. The Applicant, therefore, requested to permit him to publish the citation in two newspapers viz. "Free Press Journal" in English Language and in "Navbharat" in vernacular language i.e. Hindi having circulation in Mumbai, by way of substituted service upon Gaurav Ghildiyal, Son of the deceased.

Heard. Ld. Advocate for the Applicant submits that, the citation sent for service through the Office of the Sheriff was returned back by the postal authority with remark "Left" on 11th September 2025. He further submits that, the Applicant does not have any information about the whereabouts of Gaurav Ghildiyal. He, therefore, prays that the Chamber Order be allowed. 5.

Perused para 8 of the Petition. For the reasons mentioned in the affidavit in support the Chamber Order is allowed and the same is signed separately. Applicant to publish the citation in two newspapers viz. "Free Press Journal" in English Language and in "Navbharat" in vernacular language i.e. Hindi widely circulated in Mumbai, by way of substituted service upon Gaurav Ghildiyal within four weeks from the date of uploading this Order. Applicant to file the affidavit of publication once the citation is published within two weeks thereafter.

Registry is directed to issue fresh citation, if required 13.11.2025 Addl. Registrar (O.S.) / Addl. Prothonotary and Senior Master sbk
