The present Chamber Order is e-filed by the applicant for setting aside Order dated 25.06.2025, rejecting captioned Caveat under O.S.Rule 986 for non-compliance of office objections.
Ld. Advocate for the applicant made a statement that respondent was served with the Chamber and Affidavit of Service is e-filed. Statement is accepted. Despite service, none appeared for the respondent.
Heard ld. Advocate for the applicant. Perused Affidavit in Support, contents of which are self-explanatory. It is contended that due to inadvertence and oversight, office objections could not be removed in time. So also, delay of 45 days was caused in filing present Chamber Order, which was not intentional. Ld. Advocate for the applicant submits that now he will pursue with the captioned Caveat diligently and prays for restoration of Caveat by condoning delay.
Reasons mentioned in the Affidavit, remained uncontested for want resistance on the part of respondent. Hence, I do not hesitate to rely on the same for the purpose of restoration of captioned Caveat. Hence, in the interest of justice, delay of 45 days caused in filing present Chamber Order is condoned and present Chamber Order is granted as prayed.
The caveatrix to remove office objections of Caveat and get the same registered and/or numbered by filing/uploading compliance praecipe within two weeks from the date of order, failing Caveat to stand rejected for noncompliance of office objections under O.S.Rule 986.
