By this Chamber Order the Applicant seeks permission to serve the citation upon (1) Smt. Chitra Milind Jadhav and (2) Smt. Rashmi Ravindra Jadhav @ Vidya R. Kedare, legal heirs of the Deceased by way of substituted service as per schedule annexed to the Chamber Order.

Perused the schedule. The Applicant applies for publication of citation in two newspapers viz. "Free Press Journal" in English Language and in "Nav Shakti" in vernacular language i.e. Marathi, widely circulated newspapers in Mumbai and in the State of Maharashtra.

Perused the affidavit in support. The Applicant has stated in the affidavit in support that, the deceased died widower on 16th January 2021 and left his surviving legal heirs and next-ofkin according to Schedule I of Hindu Succession Act, 1956. It is further stated that, due to some inadvertences, the names of two daughter-in-laws of deceased viz. (1) Smt. Chitra Milind Jadhav and
(2) Smt. Rashmi Ravindra Jadhav @ Vidya R. Kedare, could not be mentioned. It is further stated that, the Bailiff of the Sheriff of

Bombay visited the residence of Smt. Rashmi Ravindra Jadhav @ Vidya R. Kedare to serve the citation, but the same could not be served upon her as she has sold the premises to the present occupant Mrs. Urmila Purohit. It is further stated that, Smt. Chitra Milind Jadhav was not found at her address upon reaching the her building the same has been vacate and demolished by RDBI Realty Developers and upon making inquiry with the security guard who informed that he has not been aware of said Mrs. Chitra Milind Jadhav and her address. The Applicant, therefore, requested to permit her to publish the citation in two newspapers viz. "Free Press Journal" in English Language and in "Nav Shakti" in vernacular language i.e. Marathi, widely circulated newspapers in Mumbai and in the State of Maharashtra.

Heard. Ld. Advocate for the Applicant submits that, the deceased died widower on 16th January 2021 and left his surviving legal heirs and next-of-kin according to Schedule I of Hindu Succession Act, 1956. He further submits that, due to some inadvertences, the names of two daughter-in-laws of deceased viz.
(1) Smt. Chitra Milind Jadhav and (2) Smt. Rashmi Ravindra Jadhav @ Vidya R. Kedare, could not be mentioned and inscribed in the table of legal heirs of Deceased while in pursuance of order / direction dated 7th August 2024, General Citation has been issued in the matter and same has been served upon all the noticees. As per Order dated 29th January 2025 names of abovesaid two legal heirs viz. (1) Smt. Chitra Milind Jadhav and (2) Smt. Rashmi Ravindra Jadhav @ Vidya R. Kedare has been added and included in the table by amending the petition. He further submits that, as per Order /direction dated 17th March, 2025 fresh Citation has been issued to

serve upon the said two non-consenting legal heirs of the deceased. As per affidavit of service filed by the Bailiff of the Sheriff of Bombay visited the residence of Smt. Rashmi Ravindra Jadhav @ Vidya R. Kedare could not be served upon her as she was sold the premises to the present occupant Mrs. Urmila Purohit and left long past. He further submits that, Smt. Chitra Milind Jadhav was not found at her address upon reaching the her building the same has been vacate and demolished by RDBI Realty Developers and upon making inquiry with the security guard who informed that he is not aware of said Mrs. Chitra Milind Jadhav and her address, and the affidavit of service dated 25th July, 2025 is filed by the Bailiff of Sheriff of Bombay. He, therefore, prays that the Chamber Order be allowed.

Perused para 6 of the Petition. For the reasons mentioned in the affidavit in support the Chamber Order is allowed. Applicant to publish the citation in two newspapers viz. "Free Press Journal" in English Language and in "Nav Shakti" in vernacular language i.e. Marathi widely circulated in Mumbai, by way of substituted service upon (1) Smt. Chitra Milind Jadhav and (2) Smt. Rashmi Ravindra Jadhav @ Vidya R. Kedare, daughter-in-law of the Deceased, within four weeks from the date of uploading this Order. Applicant to file the affidavit of publication once the citation is published within two weeks thereafter.
