16. CHOL/591/2025 IN S(L)/8044/2024 P.C. : The present Chamber Order is taken out by the Applicant for restoration of Suit by setting aside Order dated 27.03.2025, rejecting captioned Suit under O.S.Rule 986 for non-compliance of office objections.

Ld. Advocate for the Applicant tenders Affidavit of Service. The same is taken on record.

Heard Ld. Advocate for the Applicant. Perused Affidavit and Addl. Affidavit in support of the Chamber Order. It is contended that vide conditional Order dated 27.03.2025, Applicant was directed to remove office objections within four weeks. However, due to miscommunication on the part of the Advocate regarding listing of the matter, office objections could not be removed within time and the Suit got rejected. It is averred in Addl. Affidavit that delay of 147 days caused in filing present Chamber Order may be condoned and Chamber Order may be granted.

Ld. Advocates for the Applicant submits that now, they will pursue captioned Suit diligently and therefore, prays that delay caused in filing present Chamber Order may be condoned and Chamber Order may be granted.

Reasons mentioned in the Affidavit in Support appears to be bonafide, and substantial justice cannot be denied on technical grounds.

Therefore, I am of the view that the Applicant should get one opportunity to pursue with the captioned matter.
