By this Chamber Order the Applicant seeks permission to serve the citation upon (1) Pushpa Sachin Waghamare, daughterin-law of the deceased, (2) Piyush Sachin Waghamare, grandson of the deceased, and (3) Smruthi Sachin Waghamare, granddaughter of the deceased, by way of substituted service as per schedule annexed to the Chamber Order.

Perused the schedule. The Applicant applies for publication of citation in two newspapers viz. "Free Press Journal" in English Language and in "Nav Shakti" in vernacular language i.e. Marathi, widely circulated in Mumbai.

Perused the affidavit in support and additional affidavit. The Applicant has stated in the affidavit that, Shri Sachin Vasant Waghmare, son of the deceased died on 25th March 2012 and the abovenamed (1) Pushpa Sachin Waghamare, (2) Piyush Sachin Waghamare, and (3) Smruthi Sachin Waghamare, legal heirs of the deceased had left the residence and their present whereabouts are not known to the Applicant. It is further stated that, despite taking efforts to trace them, she did not get any information and their present whereabouts are not known. The Applicant, therefore,

requested to permit her to publish the citation in two newspapers viz. "Free Press Journal" in English Language and in "Nav Shakti" in vernacular language i.e. Marathi, widely circulated in Mumbai. 4.

Heard. Ld. Advocate for the Applicant submits that, Shri Sachin Vasant Waghmare, son of the deceased died on 25th March 2012 and the abovenamed (1) Pushpa Sachin Waghamare, (2) Piyush Sachin Waghamare, and (3) Smruthi Sachin Waghamare, legal heirs of the deceased had left the residence and their present whereabouts are not known to the Applicant. She further submits that, despite taking efforts to trace them, the Applicant did not get any information and their present whereabouts are not known. She, therefore, prays that, Chamber Order be allowed. 5.

Perused para 8 of the Petition. For the reasons mentioned in the affidavit in support and additional affidavit the Chamber Order is allowed. Applicant to publish the citation in two newspapers viz. "Free Press Journal" in English Language and in "Nav Shakti" in vernacular language i.e. Marathi, widely circulated in Mumbai, by way of substituted service of citation upon (1) Pushpa Sachin Waghamare, (2) Piyush Sachin Waghamare, and (3) Smruthi Sachin Waghamare, legal heirs of the deceased within four weeks from the date of uploading this Order. Applicant to file the affidavit of publication once the citation is published within two weeks thereafter.
