Shamim & Co., Advocate for Petitioner ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) P.C. : The present Chamber Order is e-filed by the Applicant for setting aside Order dated 19.09.2025, rejecting captioned Caveat under O.S.Rule 986 for non-compliance of office objections.
Today, Ld. Advocate for Petitioner is present. She objected for restoration of captioned Caveat and submits that suitable order may be passed in the present Chamber Order.
Heard Ld. Advocate for the Applicant. Perused Affidavit in Support of the Chamber Order. It is contended therein that the earlier Advocate neither removed office objections on the Caveat due to his health condition, nor he informed Caveator about the non-removal of office objections. It is further contended that in the first week of November 2025, when the Caveator came to know about the conditional order, he immediately appointed present Advocate and hence, there is delay of 8 days in e-filing the present Chamber Order.
Ld. Advocate for the Applicant submits that delay, as above, caused in present Chamber Order was unintentional and it may be condoned and captioned Caveat may be restored to file.
Reason mentioned in the Affidavit-in-Support appears to be bonafide, and substantial justice cannot be denied on technical ground. Further, .... 2

the Applicant has explained delay, as above, satisfactorily. Therefore, the Applicant should get one opportunity to pursue with the captioned Caveat.
) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) In view thereof, delay of 8 days, caused in filing present Chamber Order, is condoned and the present Chamber Order is granted as prayed subject to payment of cost of Rs. 5,000/- to the Petitioner, within three working days from today. Upon payment of cost, as mentioned above, the Caveator to remove office objections on the Caveat and get the same registered and/or numbered within two weeks from the date of payment of cost, failing the Caveat to stand rejected for noncompliance of office objections under O.S.Rule 986.
