By this Chamber Order the Applicant seeks permission to serve the citation upon (1) Mrs. Malvika Vijay Vyas, daughter-inlaw and (2) Ms. Khayati Vijay Vyas, Granddaughter of the Deceased by way of substituted service as per schedule annexed to the Chamber Order.

Perused the schedule. The Applicant applies for publication of citation in two newspapers viz. "Free Press Journal" in English language and in "Janmabhoomi" in vernacular language i.e. Gujarati.

Perused the affidavit in support. The Applicant has stated in the affidavit in support that, the Citation alongwith true copy of the Original Petition was sent for service upon Mrs. Malvika Vijay Vyas and Ms. Khayati Vijay Vyas, being the daughter-in-law and granddaughter of the deceased respectively on 30th July, 2025 and the said packets were not served upon them and returned back on 7th August 2025 with the remark "Left". It is further submitted that the bailiff of Sheriff of Bombay has filed an affidavit of service dated 4th November 2025. The Applicant, therefore, requested to permit her to publish the citation by way of service upon Mrs.

Malvika Vijay Vyas and Ms. Khayati Vijay Vyas, being the daughterin-law and granddaughter of the deceased, in two newspapers viz. "Free Press Journal" in English language and in "Janmabhoomi" in vernacular language i.e. Gujarati.

Heard. Ld. Advocate for the Applicant submits that,the Citation alongwith true copy of the Original Petition was sent for service upon Mrs. Malvika Vijay Vyas and Ms. Khayati Vijay Vyas, being the daughter-in-law and granddaughter of the deceased respectively at their address at Indore, Madhya Pradesh, on 30th July, 2025 and the said packets were not served upon them and returned back on 7th August 2025 with the remark "Left". He further submits that the bailiff of Sheriff of Bombay has filed an affidavit of service dated 4th November 2025. He, therefore, prays that the Chamber Order be allowed.

Perused para 10 of the Petition. For the reasons mentioned in the affidavit in support the Chamber Order is allowed. Applicant to publish the citation in newspaper in two newspapers viz. "Free Press Journal" in English language and in "Janmabhoomi" in vernacular language i.e. Gujarati at Indore, in the State of Madya Pradesh, by way of substituted service upon ALL CONCERNED, Legal Heirs of the Deceased, within four weeks from the date of uploading this Order. Applicant to file the affidavit of publication once the citation is published within two weeks thereafter. 6.
