CHOL/615/2025 in TPL/17505/2024 ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) Ms. Sakshi Motani i/b. Khanvilkar Omkar Mohan, Advocate for the applicant.

P.C.:

The present Chamber Order is e-filed by the applicant for setting aside Order dated 08.08.2025, rejecting captioned Petition under O.S.Rule 986 for non-compliance of office objections.

Heard ld. Advocate for the applicant. Perused Affidavit in Support, contents of which are self-explanatory.

It is contended that petitioner no. 1 was hospitalized due to which office objections could not be complied with in stipulated time. Ld. Advocate submits that now she will pursue with the captioned Petition diligently once it is restored to file and requests for restoration of captioned Petition. Ld. Advocate made a statement that as on date, captioned Petition is uncontested.

Statement is accepted.

Reasons mentioned on oath, appeared to be genuine and substantial justice cannot be denied on technical ground. In my view, the applicant has made out a case for restoration of captioned petition.

Hence, present Chamber Order is granted as prayed.

The petitioner to remove office objections of Petition and get the same registered and/or numbered within two weeks from the date of uploading of order, failing Petition to stand rejected for non-compliance of O.S.Rule 986.
