CHOL/616/2025 Ms. Sujata Popalkar, Advocate for Petitioner in CTS(L)/7116/2025 P.C. : The present Chamber Order is filed by the Applicant for setting aside Order dated 07.05.2025 rejecting captioned Caveat under O.S. Rule 986 for non-compliance of office objections. Affidavit of Service showing service of present Chamber Order is already filed.

Heard Ld. Advocate for the Applicant. Perused Affidavit in support of the Chamber Order. It is contended therein that as the Applicant was travelling at the relevant time and he failed to take follow up and to communication with the Advocate. It is further contended therein that due to the aforesaid reasons, there is delay of 44 days in filing present Chamber Order.

Ld. Advocate for Applicant made a statement that now, he will pursue captioned matter diligently and hence delay of 44 days caused in filing present Chamber Order be condoned and Chamber Order may be allowed. Statement is accepted.

Ld. Advocate for Petitioner submits that appropriate order may be passed.

Considering the statement made by Ld. Advocate for Applicant and the grounds mentioned in the Affidavit, I am of the view that the Applicant should get one opportunity to pursue with the captioned Application diligently.
