By this Chamber Order the Applicant seeks permission to serve the Notice upon (1) Ms. Gulu Fali Mistri, daughter of the Deceased and (2) Shri Kaizad Naval Mistri, Grandson of the deceased by way of substituted service as per schedule annexed to the Chamber Order.

Perused the schedule. The Applicant applies for publication of Notice in two newspapers viz. "Free Press Journal" in English language and in "Gujarat Samachar" in vernacular language i.e. Gujarati.

Perused the affidavit in support. The Applicant has stated in the affidavit that, (1) Ms. Gulu Fali Mistri, daughter of the deceased and (2) Shri Kaizad Naval Mistri, Grandson of the deceased severed all ties and from the past 25 and 10 years respectively, they had no contacts and their whereabouts are not known to the Applicant. It is further stated that, upon making inquiry with their relatives it is informed that, they were last heard to be residing in Mumbai. The Applicant, therefore, requested to permit her to publish the Notice by way of service upon (1) Ms.

Gulu Fali Mistri, daughter of the deceased and (2) Kaizad Naval Mistri, grandson of the deceased, in two newspapers viz."Free Press Journal" in English language and in "Gujarat Samachar" in vernacular language i.e. Gujarati widely circulated in Mumbai. 4.

Heard. Ld. Advocate for the Applicant submits that, (1) Ms. Gulu Fali Mistri, daughter of the deceased and (2) Shri Kaizad Naval Mistri, Grandson of the deceased severed all ties and from the past 25 and 10 years respectively, they had no contacts and their whereabouts are not known to the Applicant. She further submits that, upon making inquiry with their relatives it is informed that, they were last heard to be residing in Mumbai. She, therefore, prays that the Chamber Order be allowed.

Perused para 4 of the Petition. For the reasons mentioned in the affidavit in support the Chamber Order is allowed. Applicant to publish the Notice in two newspaper viz. "Free Press Journal" in English language and in "Gujarat Samachar" in vernacular language i.e. Gujarati, widely circulated in Mumbai, by way of substituted service upon (1) Ms. Gulu Fali Mistri, daughter of the deceased and (2) Shri Kaizad Naval Mistri, grandson of the Deceased, within four weeks from the date of uploading this Order. Applicant to file the affidavit of publication once the Notice is published within two weeks thereafter.
