This matter has been circulated at the instance of the Applicant submitting that a formal order is required after service of notice under Order XXI Rule 34 of the Code of Civil Procedure, 1908 ( the "CPC") through publication.

Mr. Sawant, learned Counsel appears for the Applicant and submits that this Court had on 23rd December, 2025 made the notice under Order XXI Rule 34 of the CPC absolute and directed that the execution to proceed as per law. That this Court in view of the service of the notice under Order XXI Rule 34 of the CPC made absolute, pass direction in terms of the Column J.

Having heard the learned Counsel and having considered his submissions, in the light of the notice under Order XXI Rule 34 of the CPC having been made absolute, direction in terms of the assistance as sought in terms of Column J, as no objection has been received after the service of notice under Order XXI Rule 34 of the CPC on 30th January, 2026.
