By this Chamber Order, the Plaintiff seeks liberty to serve the writ of summons upon Defendant No. 5 Sarya Chimanlal Vora by way of substituted service by publishing the writ of summons in two newspapers viz. "Business Standard" in English Language and "Pudhari" in vernacular language i.e. Marathi and upon Defendant No. 6 Pragnaben Prabhulal Joshi, by way of substituted service by publishing the writ of summons in two newspapers viz. "Times of India" in English Language and "Divya Bhaskar" in vernacular language i.e. Gujarati. 2.

Perused the affidavit in support. Ld. Advocate for the Applicant / Plaintiff submits that, building in which the Defendant No. 5 was having last known address is let out. He further submits that, the Plaintiff is not aware of the present address of the Defendant No. 5. He further submits that, the writ of summons sent for service upon Defendant No. 6, the packet came with postal remark "insufficient address". He, therefore, prays that, the Chamber Order be allowed.

For the reasons mentioned in the affidavit in support the Chamber Order is allowed. Plaintiff to publish the writ of summons by way of substituted service upon the Defendant No. 5 by publishing the writ of summons in two newspapers viz. "Business Standard" in English Language and "Pudhari" in vernacular language i.e. Marathi wide circulation in Mumbai and to publish the writ of summons by way of substituted service upon the Defendant No. 6 by publishing the writ of summons in two newspapers viz. "Times of India" in English Language and "Divya Bhaskar" in vernacular language i.e. Gujarati wide circulation at Vadodara, State of Gujarat, within three weeks from the date of uploading this Order.

Plaintiff to file affidavit of publication once the publication is done within two weeks.
