By this Chamber Order the Applicant seeks permission to serve the Citation upon Tarun Lachmandas Adavani, son of the deceased by way of substituted service as per schedule annexed to the Chamber Order.

Perused the schedule. The Applicant applies for publication of citation in two newspapers viz. "Free Press Journal" in English language and in "Nav Bharat" in vernacular language i.e. Hindi.

Perused the affidavit in support. The Applicant has stated in the affidavit that, the citation was sent for service upon Tarun Lachmandas Adavani, through the bailiff of Sheriff of Bombay could not be served upon him. A copy of the bailiff report is annexed to the affidavit in support. The Applicant, therefore, requested to permit him to publish the citation by way of substituted service upon Tarun Lachmandas Adavani, son of the deceased, in two newspapers viz."Free Press Journal" in English language and in "Nav Bharat" in vernacular language i.e. Hindi widely circulated in Mumbai.

Heard. Ld. Advocate for the Applicant submits that, the citation was sent for service upon Tarun Lachmandas Adavani, through the bailiff of Sheriff of Bombay could not be served upon him. He further submits that, the bailiff has submitted his report dated 20th June, 2025 and reported that, at the time of his visit the premises was found locked and upon making enquiry it was informed to the Bailiff that Shri Tarun Lachmandas Adavani has gone to work early in the morning and comes back late night. He, therefore, prays that the Chamber Order be allowed. 5.

Perused para 8 of the Petition. For the reasons mentioned in the affidavit in support the Chamber Order is allowed. Applicant to publish the citation in two newspaper viz. "Free Press Journal" in English language and in "Nav Bharat" in vernacular language i.e. Hindi, widely circulated in Mumbai, by way of substituted service upon Shri Tarun Lachmandas Adavani, son of the Deceased, within four weeks from the date of uploading this Order. Applicant to file the affidavit of publication once the citation is published within two weeks thereafter.
