This Chamber Order has been taken out by the Applicant / Plaintiff to serve the Writ of Summons upon the Defendant No. 4 Susarthak Builders Private Ltd., by way of substituted service as per the schedule annexed to the Chamber Order.

Perused the affidavit in support. Ld. Advocate for the Applicant / Plaintiff submits that, the Writ of Summons sent for service upon the Defendant NO. 4 has been returned with postal remark "No such person in the address". He further submits that, the bailiff of Sheriff of Bombay has filed an affidavit of service dated 28th June 2025. He, therefore, prays that Applicant be permitted to serve the Writ of Summons upon Defendant No. 4 by way of substituted service by publishing in two newspapers viz. "Free Press Journal" in English language and "Nav Shakti" in vernacular language i.e. Marathi having circulation in Mumbai, as per schedule annexed to the Chamber Order.

For the reasons stated in the affidavit in support Chamber Order is allowed. Applicant to publish the Writ of Summons
