CHOL/663/2025 in TPL/15567/2024 ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) Mr. Kushal Harnesha a/w. Yashika Jain, Advocate for the applicant.

P.C.:

The present Chamber Order is e-filed by the applicant for setting aside Order dated 25.07.2025, rejecting captioned Petition under O.S.Rule 986 for non-compliance of office objections.

Heard ld. Advocate for the applicant. Perused Affidavit in Support, contents of which are self-explanatory. It is contended that due to inadvertence error on the part of clerk of Advocate, office objections could not be removed within given time. It is further contended that delay of 47 days caused in filing present Chamber Order, which was not intentional. Ld. Advocate for the applicant made a statement that as on date, captioned Petition is uncontested. Statement is accepted. Ld. Advocate further submits that now he will pursue with captioned Petition diligently if it is restored to file and prays for restoration of the same by condoning delay.

Reason mentioned in Affidavit appears to be genuine and substantial justice cannot be denied on technical ground. Hence, in the interest of justice, delay of 47 days caused in filing present Chamber Order is condoned and present Chamber Order is granted as prayed.

The petitioner to remove office objections of Petition and get the same registered and/or numbered by filing/uploading compliance praecipe within two weeks from the date of order, failing Petition to stand rejected for noncompliance of office objections under O.S.Rule 986.
