By this Chamber Order the Applicant seeks permission to serve the Citation upon (1) Smt. Pooja Vishal Narvekar, granddaughter of the deceased (2) Chetan Manohar Koligude, grandson of the deceased (3) Yojana Ashok Kamble granddaughter of the deceased (4) Rupa Ajay Kamble granddaughter of the deceased (5) Sandya Prakash Gondhali granddaughter of the deceased (6) Manju Somnath Sonawane, granddaughter of the deceased (7) Shiddarth Shankar Waghmare, granddaughter of the deceased (8) Prathibha Kalyanji Kamble, married daughter of the deceased by way of substituted service as per schedule annexed to the Chamber Order.

Perused the schedule. The Applicant applies for publication of citation in two newspapers viz. "Free Press Journal" in English language and in "Nav Shakti" in vernacular language i.e. Marathi.

Perused the affidavit in support. The Applicant has stated in the affidavit that, the citation sent for service upon the abovenamed legal heirs of the deceased, through the bailiff of

Sheriff of Bombay were returned unserved with remark "door locked, addressee absent, unclaimed, as the case may be. The bailiff has filed the affidavit of service dated 10th September 2025. The Applicant, therefore, requested to permit her to publish the citation by way of substituted service upon the abovenamed legal heirs of the deceased, in two newspapers viz."Free Press Journal" in English language and in "Nav Shakti" in vernacular language i.e. Marathi widely circulated in Mumbai.

Heard. Ld. Advocate for the Applicant submits that, the citation sent for service upon the abovenamed legal heirs of the deceased, through the bailiff of Sheriff of Bombay were returned unserved with remark "door locked, addressee absent, unclaimed, as the case may be. He further submits that, the bailiff has filed the affidavit of service dated 10th September 2025. He, therefore, prays that the Chamber Order be allowed.

Perused para 9 of the Petition. For the reasons mentioned in the affidavit in support the Chamber Order is allowed. Applicant to publish the citation in two newspaper viz. "Free Press Journal" in English language and in "Nav Shakti" in vernacular language i.e. Marathi, widely circulated in Mumbai, by way of substituted service upon abovenamed legal heirs of the Deceased, within six weeks from the date of uploading this Order. Applicant to file the affidavit of publication once the citation is published within two weeks thereafter.
