By this Chamber Order the Applicant seeks permission to serve the Citation upon (1) Puneet Deepak Gawri and (2) Naineet Deepak Gawri, grandson of the deceased by way of substituted service as per schedule annexed to the Chamber Order. 2.

Perused the schedule. The Applicant applies for publication of citation in two newspapers viz. "Free Press Journal" in English language and in "Janmbhoomi" in vernacular language i.e. Gujarati, widely circulated in Mumbai and in the State of Maharashtra.

Perused the affidavit in support. The Applicant has stated in the affidavit that, the Petitioners are not in touch with the heirs of Shri Deepak Rajinder Gawri, after his death. It is further stated that, the Applicants do not have any information about their whereabouts and they have no source to ascertain the whereabouts of (1) Puneet Deepak Gawri and (2) Naineet Deepak Gawri, grandson of the deceased. The Applicant, therefore, requested to permit him to publish the citation by way of substituted service upon the abovenamed legal heirs of the deceased, in two

newspapers viz."Free Press Journal" in English language and in "Janmbhoomi" in vernacular language i.e. Gujarati widely circulated in Mumbai and in the State of Maharashtra.

Heard. Ld. Advocate for the Applicant submits that, the Petitioners are not in touch with the heirs of Shri Deepak Rajinder Gawri, after his death. It is further stated that, the Applicants do not have any information about their whereabouts and they have no source to ascertain the whereabouts of (1) Puneet Deepak Gawri and (2) Naineet Deepak Gawri, grandson of the deceased. He further submits that, the deceased had stated in her Will that the daughter-in-law Smruti and grandsons Puneet and Naineet have no relations as they never wanted to maintain any sought of relations with the deceased. He, therefore, prays that the Chamber Order be allowed.

Perused para 8 of the Petition. For the reasons mentioned in the affidavit in support the Chamber Order is allowed. Applicant to publish the citation in two newspaper viz. "Free Press Journal" in English language and in "Janmbhoomi" in vernacular language i.e. Gujarati, widely circulated in Mumbai, by way of substituted service upon (1) Puneet Deepak Gawri and (2) Naineet Deepak Gawri, grandsons of the Deceased, within four weeks from the date of uploading this Order. Applicant to file the affidavit of publication once the citation is published within two weeks thereafter.
