By this Chamber Order the Applicant seeks permission to affix the copy of Citation upon (1) Dinesh Gangaram Garude and

(2) Nitin Gangaram Garude, legal heirs of the deceased by way of substituted service as per schedule annexed to the Chamber Order. 2.

Perused the schedule. The Applicant applies for affixing the copy of citation on the conspicuous part of the residence of last known address of the abovenamed legal heirs.

Perused the affidavit in support. The Applicant has stated in the affidavit that, the citation was sent for service upon (1) Dinesh Gangaram Garude and (2) Nitin Gangaram Garude, legal heirs of the deceased, at their last known address through the bailiff of Sheriff of Bombay but the same could not be served upon them. It was informed to the bailiff that, Shri Dinesh Gangaram Garude has gone for work and he returns from work late in the evening and Shri Nitin Gangaram Garude is residing at Badlapur. It is further stated that, the present address of Shri Nitin Gangaram Garude is not known to any one. The Applicant, therefore, requested to permit him to affix the citation on the conspicuous place of their last known address of abovenamed legal heirs of the deceased.

Heard. Ld. Advocate for the Applicant submits that, the citation was sent for service upon (1) Dinesh Gangaram Garude and

(2) Nitin Gangaram Garude, legal heirs of the deceased, at their last known address through the bailiff of Sheriff of Bombay but the same could not be served upon them as it was informed to the bailiff that, Shri Dinesh Gangaram Garude has gone for work and he returns from work late in the evening and Shri Nitin Gangaram Garude is residing at Badlapur. He further submits that, the present address of Shri Nitin Gangaram Garude is not known to any one. He, therefore, prays that the Chamber Order be allowed.

Perused para 9 of the Petition and report of the bailiff dated 24th November 2025. For the reasons mentioned in the affidavit in support the Chamber Order is allowed. Applicant to affix the citation at the conspicuous place of the last known address of abovenamed legal heirs of the Deceased, within four weeks from the date of uploading this Order. Applicant to file the affidavit of pasting once the citation is affixed within two weeks thereafter. 6.
