By this Chamber Order the Applicant seeks permission to serve the citation upon (1) Rajendra Chandrabhan Avhad, Grandson of the deceased, (2) Rekha Chandrabhan Avhad, Granddaughter of the deceased and (3) Jyoti Chandrabhan Avhad, Granddaughter of the deceased, by way of substituted service as per schedule annexed to the Chamber Order.

Perused the schedule. The Applicant applies for publication of citation in two newspapers viz. "Free Press Journal" in English Language and in "Navshakti" in vernacular language i.e. Marathi, widely circulated in Mumbai.

Perused the affidavit in support. The Applicant has stated in the affidavit that, parents of the deceased and the husband of the deceased predeceased and deceased do not have any children. It is further stated that, the husband of the deceased had one sister and three brothers of which two brothers have predeceased the deceased. It is further stated that the, citation sent for service upon (1) Rajendra Chandrabhan Avhad, Grandson of the deceased, (2) Rekha Chandrabhan Avhad, and (3) Jyoti

Chandrabhan Avhad, Granddaughters of the deceased through the Sheriff of Bombay was returned by postal authority with remark "concerned person does not reside in this building." The Applicant, therefore, requested to permit him to publish the citation in two newspapers viz. "Free Press Journal" in English Language and in "Navshakti" in vernacular language i.e. Marathi, widely circulated in Mumbai.

Heard. Ld. Advocate for the Applicant submits that, parents of the deceased and the husband of the deceased predeceased and deceased do not have any children. She further submits that, the husband of the deceased had one sister and three brothers of which two brothers have predeceased the deceased. She further submits that, the citation sent for service upon (1) Rajendra Chandrabhan Avhad, Grandson of the deceased, (2) Rekha Chandrabhan Avhad, and (3) Jyoti Chandrabhan Avhad, Granddaughters of the deceased through the Sheriff of Bombay was returned by postal authority with remark "concerned person does not reside in this building." She further submits that, the bailiff of Sheriff of Bombay has filed an affidavit of service dated 3rd December 2025. She further submits that, the fresh citation be issued. She, therefore, prays that, the Chamber Order be allowed. 5.
Perused para 8 of the Petition. For the reasons mentioned in the affidavit in support the Chamber Order is allowed. Applicant to publish the citation in two newspapers viz. "Free Press Journal" in English Language and in "Navshakti" in vernacular language i.e. Marathi, widely circulated in Mumbai, by way of substituted service of citation upon (1) Rajendra Chandrabhan Avhad, Grandson of the deceased, (2) Rekha Chandrabhan Avhad,

Granddaughter of the deceased and (3) Jyoti Chandrabhan Avhad, Granddaughter of the deceased, within four weeks from the date of uploading this Order. Applicant to file the affidavit of publication once the citation is published within two weeks thereafter. 6.
