16. CHOL/737/2025 IN WP(L)/35000/2023 P.C. : The present Chamber Order is e-filed by the Applicant for setting aside Order dated 29.07.2025, rejecting captioned Petition under O.S.Rule 986 for non-compliance of office objections.

Ld. Advocate for the Applicant submits that he has e-filed Affidavit of Service dated 25.11.2025 showing service of Chamber Order upon other side.

Despite service, none appeared for and on behalf of the Respondents.

Heard Ld. Advocate for the Applicant. Perused Affidavit in support of the Chamber Order. It is contended therein that vide conditional Order dated 29.07.2025, Applicant was directed to remove office objections within four weeks. Due to miscommunication with the earlier Advocate, Applicant was constrained to appoint new Advocate. Further, in the month of September 2025, when newly appointed Advocate uploaded documents in compliance of removal of office objections, the same was rejected as matter was already disposed of.

Ld. Advocate for the Applicant submits that now, he will pursue captioned Petition diligently and therefore, prays that present Chamber Order may be allowed.

) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) Reasons mentioned on oath, as above, by the Applicant remain uncontested for want of resistance from the Respondents' side. Therefore, I am of the view that the Applicant has made out a case for restoration of captioned Petition.

In view thereof, present Chamber Order is granted as prayed and signed separately.

The Petitioner to remove office objections on the Petition and get the same registered and/or numbered within two weeks from the date of uploading of order, failing Petition to stand rejected for non-compliance of office objections under O.S.Rule 986.
