SHARAYU PANDURANG KHOT 1.

By this Official Assignee's Report, the Show Cause Notice has sought to be issued against the Insolvent Afzal Khan for having Digitally signed by SHARAYU PANDURANG KHOT Date:

2025.06.21 15:48:53 +0530 committed contempt of Court by violating and not obeying the order dated 5th December 2023 passed by this Court and further directions 1/3

that the Official Assignee may be permitted to break open the lock of the premises, viz. 99A, CST Road, Kalina Village, Santacruz (E), Mumbai, with the help of concerned Police Station for taking formal possession and making inventory.

Official Assignee's Report had come up before this Court on 4th March 2025, when this Court had considered the submission of Mr. Patil, the learned Counsel for the Insolvent, that when the representative of the Official Assignee visits the aforementioned premises on 4th April 2025 at 12:00 noon for taking formal possession, the Insolvent and his family members will co-operate. This statement was accepted as an undertaking to this Court. 3.

The Official Assignee today has confirmed that the Insolvent has handed over the possession of the aforementioned premises on 4th April 2025.

Accordingly, no directions are required to be passed in the Official Assignee's Report, in view of the Insolvent having complied with his statement recorded in the order dated 5th December 2023 passed by this Court.
