The Insolvent is untraceable as per the Official Assignee's Report dated 2 September 2008. The whereabouts of the Insolvent is not known inspite of the best efforts taken by the office and the Petitioner. As per the report, sum of Rs.441/- is lying in the bank account. Since the Insolvent is untraceable, the question of filing the details of the assets also does not arise as stated in paragraph 4 of the Official Assignee's Report. There is an amount of Rs.441/- lying in the Estate of the Insolvent. Looking at the amount involved and after considering the materiality of the efforts required to pursue this amount, it is in the interest of justice that for administrative purpose this petition is closed.

As per prayer clause (A) of the Official Assignee's Report dated 2 September 2008, the amount of Rs.441/- lying to the credit be transferred to "Unclaimed Dividend Capital Account" as per the Rule 178 of the Presidency Towns Insolvency Rules, 1910. 3.

Ms. Shah appearing for the Petitioning Creditor also states on some instructions that the clients are not interested in pursuing the present petition.
