An attempt was made by the office of the official assignee to serve the report but, it was refused.

The amount lying in the estate account is only Rs.945/- whereas the dues are more than Rs.75 Lakhs and the matter is more than 20 years old and therefore looking at the materiality factor, the resources of the Official Assignee's office cannot be utilized for such matter. Therefore, accepting the Official Assignee's Report, prayer clauses (a) and (b) are allowed.
