The amount lying in the estate account is only Rs.268/- as against debt of Rs.1,78,000/-. The whereabouts of the insolvent is not available and for the last 20 years the petitioning creditor has not given any details. Therefore, it is not feasible to pursue this matter.

The properties mortgaged have been sold by the Banks and there are no further properties available which can be utilized for the discharge of the debt.

In view of above, the estate account is closed and the amount lying therein is transferred to unclaimed dividend capital account. 4.
