This report has been filed by the official assignee's for the reliefs sought for in prayer clauses (A) & (B) namely, the official assignee be permitted to accept Rs.1.50 crore towards full and final settlement of the claims of the insolvent for which certain part payment was made by the insolvent to the noticee.

Further prayer clause (B) also seeks execution of a cancellation of the Deed and nullification of the Agreement for Sale dated 17 April 2008 registered on 25 April 2008.

I have heard the learned counsel for the parties and the official assignee. There is no objection to grant of these prayers. Therefore, the official assignee's report is made absolute in terms of prayer clauses (A) & (B). The refund and the cancellation as sought for in prayer clauses (A) & (B) and granted by this Court today should be completed within a period of four weeks from today.
