The Court Receiver has sought discharge in the above Petition. The Court receiver informs that the copy of Court Receiver Report has been supplied to the learned Advocate for the Petitioner on the E-mail ID available with the office of Court Receiver.

Advocate Mr.Aayesh Gandhi, who has marked his presence on behalf of the Petitioner, has no objection if the Court Receiver is discharged.

In the present Petition, the Court Receiver was appointed in respect of hypothecated vehicle. The Consent

2/2 912 CRR-353-25.odt Terms dated 30/11/2017 were filed by the parties in the Court. However, no order of discharging the Court Receiver was passed.

According to the Court Receiver's Report, there has been no further correspondence or communication on part of the Petitioner, as a result no action is taken by the Court Receiver and the matter is simply pending.

Considering the fact of filing of Consent Terms in the Petition, the Court Receiver Report deserve to be allowed in terms of prayer clauses (a) and (b).

Hence, the Court Receiver Report is made absolute in terms of prayer clauses (a) and (b), which reads thus:- "(a) That the Hon'ble Court may be pleased to discharge the Court Receiver, High Court, Bombay, in view of the settlement of the matter, without passing accounts, subject to the payment of Rs.31,148/- towards costs, charges and the expenses to be borne in by the Petitioner within the stipulated period as may be directed by the Hon'ble Court;

(b) That costs of this report may be quantified at Rs.5,000/- and the Petitioner may be directed to pay the same with the Court Receiver."
