The Official Liquidator's Report seeks the following directions: "a) In view of para (7) and (8) of this report, this Hon'ble Court may be pleased to permit the Official Liquidator to appoint a panel valuer for valuation of the said flats belonging to the Company (In Liquidation) situated at flat no.5A and No.5B on 5th floor and No.11B on 11th floor of Ruby Terrace Building, Walkeshwar Ruby Terrace CHS Ltd, 100, Walkeshwar Road, Mumbai; (b) If prayer clause (a) above is in affirmative, this Hon'ble Court may be pleased to permit the Official Liquidator to make payment to the said valuer towards the professional fees for valuation of the said flats, out of the funds available to the credit of the Company (In Liquidation) after deduction of applicable taxes, if any;" Meera Jadhav

2/2 18-OLR-60-2025 (OS).doc Heard Mr, Sheth, learned counsel appearing on behalf of the Official Liquidator, who points out that after the order of winding up was passed, the official liquidator has taken physical possession of the said flats (4 flats) in question, which belong to the company in liquidation and are situated at Ruby Terrace Building, Walkeshwar Ruby Terrace CHS Ltd, 100, Walkeshwar Road, Mumbai-400006; and have pasted the necessary notices on the said flats. He submits that since the final liquidation order has came to be passed, the flats would now have to be valued, for which purpose, the official liquidator seeks appointment of the valuer from the panel of this Court.

Having due regard to the submissions made and having perused the report in particular paragraph nos.7 and 8 of the report, I am inclined to allow the report in terms of prayer clauses (a) and (b) which are reproduced above.
