The captioned Official Liquidators Report seeks the following orders and directions from this Court:

"a) In view of para (6) above, whether this Hon'ble Court may be pleased to permit the Official Liquidator to invite bids from second hand vehicle dealers to sell both the vehicles viz. Toyota Innova ILGX(8S) (MH-01- AN-0693 and Scorpio Model SLE BS$ (MH-01-AN-0710);

b) If prayer (a) is in affirmative whether this Hon'ble Court would be pleased to permit the Official Liquidator to compare the highest offer received by inviting bids from second hand vehicles dealers and the exchange offer from the dealer from whom new vehicle is proposed to purchased and if exchange offer is more than bid officer from second hand vehicles dealers, then to exchange the vehicle against new purchase of vehicle by adjusting the exchange offer price against the purchase price of respective new vehicles and to permit the Official Liquidator to deliver the old vehicles to respective dealer by executing necessary documents on that behalf. However if exchange offer is lower than offer from second hand dealer, then permitting the

2/3 Official Liquidator to move a separate report before this Hon'ble Court seeking permission to sell the vehicles to highest offer second hand dealer. c) In view of para (6) and (7) above, whether this Hon'ble Court would be pleased to permit the Official Liquidator to purchase two new vechicles (i) Toyota Crysta Gx + 7 STR Diesel model for Rs 27,51,701/(Rupees Twenty Seven Lakhs Fifty One Thousand Seven Hundred One Only) and (ii) Maruti Ertiga ZXI (MT) Petrol Model for Rs.14,42,817/- (Rupees Fourteen Lakhs Forty Two Thousand Eight Hundred Seventeen Only) for the use of the official purposes of the office of Official Liquidator;

d) If the orders in terms of prayer (c) above is in the affirmative, whether this Hon'ble Court would be pleased to permit the Official Liquidator to pay the cost of the Toyota Crysta Gx + 7 STR Diesel model out of the funds of the "Common Pool Fund Account of the Official Liquidator, High Court, Bombay."

and the cost of one Maruti Ertiga ZXI (MT) Petrol Model out of the funds available from the "Printing and Stationery Account", and to permit the Official Liquidator to pay the road tax, registration fee, extended warranty and other charges for purchase of both new vehicles on road; e) In view of para (6) and (7) above, whether this Hon'ble court would be pleased to permit the Official Liquidator to register the two new vehicles in the name of the "Official Liquidator, High Court, Bombay;" f) If the orders in terms of prayer (d) and (e) are in affirmative, whether this Hon'ble Court would be pleased to permit the Official Liquidator to incur the expenses on fuel, maintenance, insurance and other incidental charges of both the vehicles from the "Common Pool Fund Account of the Official Liquidator, High Court, Bombay."

Heard Ms. Agarwal, learned counsel appearing on behalf of the Applicant/Official Liquidator.

Ms. Agarwal points out that the present Official Liquidators Report necessitated on account of the fact that the Official Liquidators Office would now have to sell/replace two vehicles which had been purchased by the Office

3/3 of the Official Liquidator in the year 2014 pursuant to orders passed in Official Liquidators Report No.287 of 2014. She has taken me through the contents of the report and has pointed out that the vehicles now being over 10 years old are giving problems and the Office of the Official Liquidator has to incur heavy maintenance costs in respect of the same.

Ms. Agarwal points out that it is for these reasons that the Official Liquidator has filed present report, in which the Official Liquidator has also provided for a mechanism to ensure the best price is received from the sale of the current vehicles.

Having due regards to the submissions having made by Ms. Agarwal and having noted the facts that the vehicles are now in use by the Office of the Official Liquidator for a period of over 10 years and that the Office of the Official Liquidator is incurring substantial maintenance charges in respect of the same. I am inclined to allow the Official Liquidators Report in terms of prayer clause (a) to (f) which already reproduced above. 6.

The Official Liquidators Report is accordingly disposed of. (ARIF S. DOCTOR, J.)
