Today, a revised valuation report has been placed before the Court. The same is a substantial improvement over the previous valuation. 2.
On a perusal of the said valuation report as also the photographs, I find that the cars are in an extremely distressed condition. 3.
Hence, the valuation report is accepted. The liquidator shall proceed to sell the said vehicles. It Official Liquidator's Report is allowed in terms of prayer clauses (b), (c) and (d), which reads thus:
"b) In view of averments made in paragraph (9) of the present report, whether this Hon'ble Court would be pleased to approve the "Sale Notice" and "Terms and Conditions of Sale", which are annexed hereto as Exhibit - "E1" and "E2" and permit the Official Liquidator to upload the approved "Sale Notice" on the website of this Hon'ble Court, Ministry of Kiran Kawre
2/2 42-OLR-94-2025 (OS).DOC Corporate Affairs and website of PSB Alliance Private Limited, the Auctioneer agency;
c) In view of averments made in paragraph (10) of the present report, whether this Hon'ble Court would be pleased to permit the Official Liquidator to publish the 'Sale Notice' in newspaper namely "Free Press Journal" (English) and "Navshakti" (Marathi) both published and having circulation / publication in Mumbai and Raigad through Panel Advertising agency and to pay the advertisement charges from the common pool fund subject to reimbursement of same from the fund recovered in future and subject to deduction of TDS and other applicable Taxes the;
d) In view of averments made in paragraph (11) of the present Report, whether this Hon'ble Court would be pleased to permit the Official Liquidator to sell the movables assets (Cars) lying/parked at various locations in Mumbai in four lots (Company wise) through e-auction by PSB Alliance Private Limited, the Auctioneer agency and place further report before this Hon'ble Court for confirmation of the highest bidder in e-auction;"
