The captioned Official Liquidator Report seeks the following directions from this Court:
"a) In view of paras (7) to (10) of this report, whether this Hon'ble Court would be pleased to ratify the action of the Official Liquidator for appointment of panel valuer namely V S Jadon & Co, valuers LLP for valuation of Car i.e Honda Accord V6 AT Registration No. MH01-AW-2127 parked at Swadeshi Mills Compound, Near Chunabhatti Railway Station, Sion, Mumbai and permit the Official Liquidator to pay the valuation charges amounting to Rs.2,950/- after deduction of applicable taxes if any. This Hon'ble Court may permit the Official Liquidator to pay valuation charges from the "Common Pool Fund" with condition to recoup the amount with 9% Meera Jadhav

b) In view of para (11) of this report, whether this Hon'ble Court would be pleased to permit the Official Liquidator to make fresh valuation of Car (Honda Accord V6 AT Registration No.MH-01AW-2127) parked at Swadeshi Mills Compound, Near Chunabhatti Railway Station, Sion, Mumbai and for the reason this Hon'ble Court would be pleased to permit the Official Liquidator to appoint valuer on the panel of the Official Liquidator and permit the Official Liquidator to pay valuation charges after deduction of applicable taxes if any.
This Hon'ble Court may permit the Official Liquidator to pay valuation charges from the "Common Pool Fund" with condition to recoup the amount with 9% interest as and when funds are available for Company (In Liquidation) and after receiving valuation report from the panel valuer, the Hon'ble Court may be pleased to permit the Official Liquidator to place further report for sale of Vehicle namely Honda Accord V6 AT Registration No. MH-01-AW2127; Ms Thipsay pointed out that the Official Liquidator would have now conduct a fresh valuation of the vehicle belonging to the company in liquidation being Honda Accord V6 AT Registration No.MH-01-AW-2127.
Ms Thipsay points out that the reason why this exercise would have to be done again is the fact that the previous valuation report is of the 2021, after which substantial time has elapsed and there would be a deterioration in the condition of the car and consequently a diminution in the value.
Having due regard to submissions made, I find that the report would have to be allowed, the same is allowed in terms of prayer clauses (a) and (b). The Official Liquidator Report is accordingly disposed of. [ARIF S. DOCTOR, J.] Meera Jadhav
