By the captioned Official Liquidator Report, the Official Liquidator seeks the following substantive directions:- "a) In view of submissions made in paragraph (7) of this report, whether this Hon'ble Court be pleased to permit the Official Liquidator to invite claims from the creditors / workers under Rule 148 of the Companies (Court) Rules, 1959 by publishing Notice for inviting claims in newspapers, i.e. "Free Press Journal" (English) and "Navshakti" (Marathi), both published and having publication in Mumbai through the Panel Advertising Agency in respect of the Companies as mentioned in paragraph 3 of the present report, and to pay the professional fees of Panel Advertising Agency, out of 'Common Pool Fund Account Company Paid Staff Salary Reserve Fund Account', subject to deductions of applicable taxes, if any; b) In view of submissions made in paragraph (8) of this report, whether this Hon'ble Court may be pleased to permit the Official Liquidator to appoint the Panel Chartered Accountant for adjudication of the claims of the workers, and to file list of such Meera Jadhav
2/2 13-OLR-140-2025 (OS).doc admitted claims of workers with this Hon'ble Court and also permit the Official Liquidator to pay the professional fees of Panel Chartered Accountants as already approved by this Hon'ble Court in respect of the Companies as mentioned in paragraph 3 of the present report and vide order dated 26.04.2023 passed on Official Liquidator Report No.51 of 2023, from 'Common Pool Fund Account Company Paid Staff Salary Reserve Fund Account', subject to deductions of applicable taxes, if any and subject reimbursement of the same @9% as and when funds are available to the credit of the Company (In Liquidation) as per order of this Hon'ble Court dated 30.08.2019 passed on Official Liquidator Report No.
192 of 2019; Heard Ms Agarwal, learned counsel appearing on behalf of the Official Liquidator, who submits that the Official Liquidator will have to take necessary steps to invite the claims as next step after the winding up order. It is for this purpose that the present Official Liquidator Report has been taken out. Ms Agarwal points out that the report pertains to 10 companies the details of which are set out in the paragraphs 4 and 5 including the date of the winding up order. Ms Agarwal points out that the reason that 10 companies are clubbed together in one report is so that the same can all be advertised together instead of multiple advertisements which would entail multiple costs.
Having due regard to the submissions made and also the fact that what is proposed by the Official Liquidator is the next statutory step required to be taken, the report is allowed in terms of prayer clauses (a) and (b) which are reproduced above.
