The captioned Official Liquidator Report seeks the following directions from this Court.
a. In view of paras (5), (7) and (8) of this report, this Hon'ble Court be pleased to permit the Official Liquidator to sell the subject vehicles (Two) Four-Wheeler, viz Maruti SX4 ZXI bearing Number MH-12-HF-4308 and Maruti Swift VDI (0) bearing Number MH 12 PC 9215 and 1 (One) TwoWheeler i.e. Honda Activa 110 bearing Number MH 12-JH-1323 through e-auction by PSB Alliance Private Limited and permit the Official Liquidator to place further report before this Hon'ble Court for confirmation of the highest bidders in e-auction, subject to confirmation by this Hon'ble Court; b. In view of the para (6) of this report this Hon'ble Court may be pleased to the Official Liquidator is required to publish a sale notice under Rules 272 and 273 of the Companies (Court) Rules, 1959. 2/2 9-OLR-149-25.DOC this Hon'ble Court may kindly dispense with the requirement of publication of the sale notice in the respective newspapers for the sale of the subject vehicle;
c. In view of the para (9) of this report this Hon'ble Court may be pleased to approve draft "Sale Notice" draft "Terms and Conditions of Sale", Heard Ms Agrawal, learned counsel appearing on behalf of the Official Liquidator, who points out that this Court had vide an order dated 7 th August 2025 direct the sale of the said vehicles after fixing the reserve price in paragraph 3 of the said order as also the EMD amounts. Paragraph 3 reads thus: "3. As far as the four wheeler bearing Registration No. MH-12-HF4308 is concerned, the reserved price is fixed at Rs.1,25,000/- and EMD at Rs.25,000/-. As far as four wheeler vehicle bearing Registration No. MH12-PC-9215 is concerned the reserved price is fixed at Rs.3,75,000/- and EMD is fixed at Rs.25,000/-. As far as the two wheeler bearing Registration No. MH-12-JH-1323 is concerned, the reserved price is fixed at Rs.15,000/- and EMD at Rs.2,500/-."
Having due regard to the averments made and having heard Ms Agrawal, a case has been made out to permit the Official Liquidator to proceed with the eauction of the said vehicles. The Official Liquidator Report is accordingly allowed and disposed of in terms of prayer clauses (a) to (c) which are already extracted above. [ARIF S. DOCTOR, J.] Meera Jadhav
