After there was some deliberation in the matter, as a workable solution, both parties on instructions of their individual client submit that the housing society could pay a total sum of Rs.37,00,000/- and GST amount on the same as full and final settlement towards decreetal amount.

It is submitted that 50% of the members in the housing society are defaulter, due to which the problems have cropped up. It was put forward for the time being the members who are not defaulter would contribute their share and also as a matter of goodwill gesture pay for the defaulters, which monies will be recovered from their maintenance dues later. This will save the society from the current situation.

Since the society would require to hold Annual General Meeting (AGM) in order to pass relevant Resolution, on the request made by both counsel, let the matter come up on Board on 13/1/2026, under the caption "For Settlement". 4.

The amount which is already deposited with the Prothonotary and Senior Master, High Court, Bombay, including the amount which is going to be deposited during the couple of days i.e. Rs.1,32,500/-, the applicant - decree holder is permitted to withdraw the amount lying with the Prothonotary and Senior Master, High Court, Bombay.
