The disputes having been arisen between the parties out of the agreements in form of Deed of Assignment for Satellites and ATR Rights for the entire world including India dated 23/2/2000, 5/4/2000 and 20/10/2000 and the Settlement Deed dated 29/12/2005, the respective counsel are at consensus that the disputes deserve to be referred to a Sole Arbitrator.
2/4 3 CARAP 341-25.doc It is also not in dispute that there is a notice about invocation of arbitration dated 3/7/2025 with reference to the said agreements and in the wake of the ongoing conflict, and its adverse impact on the applicant's activities, the name of the arbitrator is also suggested in the said notice which receive due response dated 4/7/2025.

Today, a consensus is expressed on the appointment of a Sole Arbitrator to resolve the disputes out of the four agreements and the parties have agreed for appointment of Advocate Ranjeet Carvalho as a Sole Arbitrator. In view of the specific arbitration clause contained in the agreements providing for reference of disputes to a Sole Arbitrator, I deem it appropriate to pass the following order:- A] Mr.Ranjeet Carvalho, an Advocate of this Court is hereby appointed as the Sole Arbitrator to adjudicate upon the disputes and difference between the parties arising out of an in connection with the Agreement referred to above. The Petitioner shall prove the contact and communication particulars of the parties to the Arbitral Tribunal along with a copy of this Order; C] The Learned Sole Arbitrator is requested to forward the statutory Statement of Disclosure under Section 11(8) read with Section 12(1) of the Act to the parties within a period of two weeks from receipt of a copy of this Order; D] The parties shall appear before the Learned Sole Arbitrator on such date and at such place as indicated by him, to obtain appropriate direction with regard to conduct of the arbitration including fixing a schedule for pleadings, examination of witnesses, if any, schedule of hearings etc. E] The sole Arbitrator shall be entitled to the fees prescribed under the Bombay High Court (Fee Payable to Arbitrators) Rules, 2018 and the arbitral costs and fees of the Arbitrator shall be borne by the parties in equal portion and shall be subject to the final Award that may be passed by the Tribunal. 3.
All issues on merits are expressly kept open to be agitated before the Arbitral Tribunal appointed hereby. 4.
Arbitration Petition as well as the Application stand disposed of.
