Learned Counsel for the Applicant points out that between the same parties arsing out of the same agreement, the Karnataka High Court has already appointed an Arbitrator. In view of the order passed by the Karnataka High Court, another Commercial Arbitration Application No. 512 2025 has already been withdrawn by the same Petitioner. 2.

In the instant case, the Applicant has not appeared before this Court on 5th May 2025 and 8th May 2025. Even today also, none appears for the Applicant.

The Commercial Arbitration Application stands dismissed for non prosecution.
