Heard Mr. Dwarkadas, learned Advocate for Plaintiff and Mr. Andhyarujina, learned Senior Advocate for Defendant. 2.

After hearing learned Advocates for the respective parties, with their consent and without prejudice to the rights and contentions of both parties the lis between the parties is referred to mediation of Mr.

4. COMS-85-2025.odt Justice S.J. Kathawalla, retired Judge of the Bombay High Court for resolution.

Parties are directed to approach the learned Mediator to fix the schedule of dates of meeting with the parties. Parties shall extend full cooperation to the learned Mediator during mediation. 4.

Both parties agree to bear the costs of mediation / Mediator's fees / charges equally.

5.

Advocate for Plaintiff shall co-ordinate with the learned Mediator and respective parties / Advocate for Defendant for the purpose of arranging the mediation meetings as per the instructions of the learned Mediator.

6.

Learned Mediator shall be entitled to call for the relevant documents as deemed fit and necessary and direct the parties to produce the same before the learned Mediator which are relevant to the dispute.

7.

Learned Mediator is requested to submit his report on or before 25.03.2026.

8.
