1) This is a Petition filed under Section 9 of the Arbitration and Conciliation Act, 1996 for interim measures alongwith 1 of

Megha 13_carap_678_2025 & carbp_26_2026.docx Application under Section 11 of the Arbitration Act for constitution of the Arbitral Tribunal.

2) As hearing of the proceedings progressed and as this Court noticed existence of arbitration agreement between the parties, both the learned counsel appearing for the parties jointly agree for constitution of arbitral Tribunal. They have jointly suggested name of Hon'ble Mr. Justice K.R. Shriram, former Chief Justice of Rajasthan High Court for being appointed as sole Arbitrator to adjudicate the disputes and differences between the parties. 3) So far as Petition under Section 9 of the Arbitration Act is concerned, Mr. Damania, the learned counsel appearing for the Petitioner, on taking instructions, submits that the Petitioner is willing to exercise the remedy under Section 17 of the Arbitration Act before the learned Arbitrator.

4) Accordingly, with the consent of the parties, following order is passed:- (A) Mr. Justice K.R. Shriram, former Chief Justice of Rajasthan High Court is appointed as Sole Arbitrator to adjudicate upon the disputes and differences between the parties arising out of Agreement dated 15 April 2025. The contact details of the Arbitrator are as under :

Megha 13_carap_678_2025 & carbp_26_2026.docx (B) A copy of this order be communicated to the learned sole Arbitrator by the Advocates for the Petitioner within a period of one week from the date of uploading of this order. The Applicant shall provide the contact and communication particulars of the parties to the Arbitral Tribunal alongwith a copy of this order. (C) The learned sole Arbitrator is requested to forward the statutory Statement of Disclosure under Section 11(8) read with Section 12(1) of the Act to the parties within a period of 2 weeks from receipt of a copy of this order.

(D) The parties shall appear before the learned sole Arbitrator on such date and at such place as indicated by him, to obtain appropriate direction with regard to conduct of the arbitration including fixing a schedule for pleadings, examination of witnesses, if any, schedule of hearings etc.

(E) All arbitral costs and fees of the Arbitral Tribunal shall be borne by the parties equally in the first instance, and shall be subject to any final Award that may be passed by the Tribunal in relation to costs.

5) The Petitioner would be at liberty to file Application under Section 17 of the Arbitration Act before the learned Arbitrator, which shall be decided on its own merits.

6) All issues on merits including the issue of arbitrability are expressly kept open to be agitated before the Arbitral Tribunal appointed as above.
