The learned Advocate for the petitioner submits the Section 11 proceedings have already been filed and the same are pending. This Court, by order dated 9 October 2025, granted ad interim relief in favour of the petitioner in terms of prayer clause (a), (b) and (c).

Since the petitioner is moved for Constitution Arbitral Tribunal, ad interim relief granted earlier by this Court on 9 October 2025 shall operate as interim relief during pendency of the arbitral proceedings, with liberty to the petitioner to apply afresh under Section 17 of the Arbitration and Conciliation Act, 1966 if facts justify filing of such application.

In view of the above, the commercial arbitration petition stands disposed of.
