This is a Petition under Section 29-A of the Arbitration and Conciliation Act, 1996 ("the Act"), seeking an extension of mandate of the Arbitral Tribunal.

A fundamental objection on behalf of the Respondent is that an earlier Petition under Section 29-A of the Act filed by the earlier Advocates on record for the Petitioner came to disposed of for nonremoval of office objections and this fact has not been pointed out in the petition.

Learned Counsel for the Petitioner submits that this fact was not known to advocates for Petitioner, and in any case, they have filed a fresh petition. Pleadings are said to have been competed on February September 3, 2025 Shraddha

3-CARBPL-714-2025.doc 18, 2024, and according to her, the mandate would have expired on June 3, 2025.

Leaving the issue of costs relating to the delays occasioned in seeking the extension of the mandate of the arbitral tribunal to the Learned Arbitral Tribunal to consider, in my opinion, no useful purpose would be served keeping this Petition pending any further, considering the activity undertaken by the arbitral tribunal already. In these circumstances, the mandate of the arbitral tribunal is extended by six months rounded down to March 31, 2026.

The Petition is finally disposed of.

All actions required to be taken pursuant to this order shall be taken upon receipt of a downloaded copy as available on this Court's website.
