DATED : 4th DECEMBER, 2025 P.C:- In the order dated 19/9/2025, it is specifically recorded that during the pendency of the proceedings, the only asset of the respondent i.e. HALANI 6(IMO) 9125906, was sought to be sold and the Court recorded the confirmation that it has been sold. It is also not in dispute that the only asset of the company is this vessel. The order also record that the amount received towards the sale of the vessel has entirely contributed to discharge of a secured debt to Saraswat Bank. Tilak
2/2 927 CARBP 727-25.doc Today, the learned senior counsel Mr.Ardeshir representing the purchaser of the said vessel and he seek intervention, and upon this request being made, the learned Senior Counsel Mr.Pratap representing the petitioner, undertake to implead him as a party respondent.
Similarly, learned counsel Mr.Khandeparkar representing the respondent is also desirous of responding to the allegations levelled in the rejoinder affidavit, as according to Mr. Khandeparkar, the accusations are serious in nature, intended to suggest that the sale transaction is a deliberate attempt to avoid the execution of the award.
In the wake of the aforesaid, let the purchaser of the subject vessel be impleaded as a party respondent forthwith. Mr.Andhyarujina waives notice on behalf of the newly added respondent and is at liberty to file affidavit on record, disclosing its transaction with the respondent. Similarly, Mr.Khandeparkar is also at liberty to file the additional affidavit.
The respective counsel agree to exchange the pleadings in advance.
Re-notify to 19/12/2025. To be listed on Supplementary Board.
