1) This is a Petition filed under Section 9 of the Arbitration and Conciliation Act, 1996 (the Arbitration Act) seeking interim measures before commencement of the arbitral proceedings. The disputes and differences have arisen between the parties out of Facility Agreement dated 13 June 2024.

2) Heard Mr. Mundhwa, the learned counsel appearing for the Petitioner.

3) Perusal of the Agreement indicates presence of arbitration clause No.26. By order dated 1 April 2026 this Court issued notice to Respondent and had granted hamdast. The affidavit of service indicates Page No.

Megha 44_carbp_852_2025 that humdast notice has been duly served on the Respondent. However, none has appeared on behalf of the Respondent. 4) The learned counsel appearing for the Applicant submits that the Respondent is not repaying the loan and that an amount of Rs.18,65,101.77 was due and payable as on 4 August 2025. He would accordingly pray for grant of interim measures in terms of prayers in the Petition.

5) Considering the position that Respondents are not opposing the Petition and have also stopped repaying the loan, it would be appropriate to make interim measures in favour of the Petitioner. 6) Accordingly, I proceed to pass the following order:- (i) Pending arbitration and till making of the final Award, there shall be interim measures in terms of prayer clause (G), which reads thus:- G. This Hon'ble Court be pleased to pass an order directing the marking of debit freeze of all the bank accounts of Respondents, including but not limited to the bank accounts linked with PAN Number BDHPJ6140H.

(ii) If the Petitioner fails to commence arbitration within a period of 90 days, the interim measures shall come to an end.
