The preliminary objection raised by Mr. Tamboly is about the Petition under Section 9 of the Arbitration and Conciliation Act, 1996, being entertained after the enforcement proceedings under Section 47 are already instituted in this Court.

The learned counsel representing the Petitioner would place reliance upon the decision of Division Bench of Delhi High Court in case of Shanghai Electric Group Co. Ltd. vs. Reliance Infrastructure Ltd.1, and also the decision of learned Single Judge of this Court in Aircon Beibars FZE vs. Heligo Charters Pvt.
