When the matter is called out, learned Counsel appearing for the Plaintiff and the Defendant No.1-Vessel tender across the bar settlement agreement / consent terms dated 22nd August, 2025, submitting that the dispute as regards the Plaintiff and the Defendant No.1 has been resolved in terms of the said consent terms, which may be taken on records and as regards the other Defendants, the Suit be allowed to be withdrawn.

The consent terms are taken on record and marked 'X' for the purposes of identification. The undertakings in the consent terms are accepted as undertakings to this Court.

The Prothonotary & Senior Mater of this Court to return the bank guarantee in terms of the paragraph 9 of the consent terms. 4.

The Suit accordingly stands disposed as regards the Plaintiff and the Defendant No.1 in terms of the said consent terms. 5.

As regards the other Defendants, the Suit stands disposed as withdrawn. Refund of Court fees as per rules. 6.

Connected Interim Application also to accordingly stand disposed.
