When the matter is called out, learned Counsel appearing in the matter tender across the bar consent terms dated 28th April, 2026, submitting that the Suit has been settled in accordance with the said consent terms and that the amount of security of Rs. 20,57,000/- that was deposited for seeking release of the Defendant-Vessel be distributed / released in favour of the Plaintiff and the owner of the DefendantVessel in terms of the said consent terms. 2.

The said consent terms are taken on record and marked 'X' for the purposes of identification.

The Prothonotary & Senior Master of this Court is directed to make payment of Rs. 15 lacs to the Plaintiff No. 1 in terms of the Nikita Gadgil 1/2

4-COMAS-47-2025.doc paragraph 7 of the consent terms. The remaining amount along with accrued interest, if any, be remitted to the account of Librus Energy and Infrastructure Pvt. Ltd. viz. the registered owners of the DefendantVessel, after deduction of bank charges in the account, details whereof are in paragraph 8 of the consent terms.

The Defendant owner to pay the applicable poundage to the Sheriff of Mumbai within a period of four weeks. 5.
