Learned Counsel for the parties have today tendered a copy of the order dated 25 th April, 2025 passed by the Delhi High Court in Commercial Suit No. 342 of 2025 ("the said Commercial Suit"). Learned Counsel pointed out that Defendant No. 1 to the present Suit was the Plaintiff to the Said Commercial

2 16-IA(L)-11766-2025.doc Suit filed in Delhi High Court and the Plaintiff herein was the Defendant. Defendant No. 2 to the present Suit was not a party to the Suit filed in the Delhi High Court.

Learned Counsel submit that parties have vide an order dated 25 th April, 2025 passed in the said Commercial Suit filed in Delhi High Court resolved their disputes and differences. He pointed out that paragraph 7 of the said order reads thus:

"The parties agree that based on the statements made before this Court and subsequent affidavits of compliance filed, the defendant will ask the High Court of Bombay to dispose of the aforesaid suit pending before it against all defendants therein in terms of the undertakings given and affidavits filed by the parties before this Court, which affidavits will also be filed before the High Court of Bombay." 3.

Mr. Kamod, Learned Counsel for the Plaintiff then tendered the affidavit in compliance of the aforesaid order. The same is taken on record. 4.

Mr. Jagtiani, Learned Senior Counsel appearing on behalf of the Defendants, submitted that Defendant No. 2 would also qua the present Suit remain bound by the undertakings given to the Delhi High Court as recorded in the aforesaid order. He further submits that Defendant No. 2 has complied with

3 16-IA(L)-11766-2025.doc the undertakings given to the Delhi High Court as recorded in the aforesaid order and shall at all times continue to ensure compliance with the same qua the present Suit. His statement is accepted.

Hence, nothing further remains in light of the settlement arrived at between the parties as recorded in the said order. The Interim Application and Suit are therefore disposed of in terms of the said order. 6.

Refund of Court fees, as per the Rules.
