IN THE HIGH COURT OF JUDICATURE AT BOMBAY
ORDINARY ORIGINAL CIVIL JURISDICTION COMMERCIAL MISCELLANEOUS PETITION NO. 1 OF 2026 Neon Laboratories Limited
...Petitioner
Versus
Controller Of Patents
...Respondent
_______ Mr. Rashmin Khandekar a/w Mr. Anand Mohan, Ms. Hemlata Marathe, Ms. Annu Alexander, Mr. Vaibhav Khanna i/b Jehangir Gulabbhai & Bilimoria & Daruwalla, for the Petitioner.
Mr. Ashish Mehta a/w Ms. Khushi Rawlani i/b Ashish Mehta, for the Respondent. _______ CORAM : ARIF S. DOCTOR, J.
st APRIL, 2026 DATE : 21 P.C.
1.
Mr. Khandekar, learned counsel for the Petitioner, has today concluded his arguments. In essence, the gist of Mr. Khandekar's submission was that the impugned order was bereft of adequate reasoning. 2.
On a prima facie reading of the order, I find merit in his submission. I have, however, not heard Mr. Mehta, learned counsel for the Respondent. I therefore put it to Mr. Mehta as to whether as had been done in several other cases where it was found that the order was bereft of reasoning, the same could be sent back for fresh consideration.
3.
Mr. Mehta submits that he would take instructions and revert. th April 2026 (HOB).
