The present Interim Application seeks a post-grant amendment to the schedule of securities which is annexed to Testamentary Petition (L) NO. 1012 of 2007, in terms of the draft amendment schedule annexed to the present Interim Application.

By an order dated 6th May 2008, this Court was pleased to issue a Succession Certificate in favour of the Applicant in respect of the estate of the deceased, Ms. Zaibunnisa Mansuri. It subsequently came to the notice of the Applicant that certain shares standing in the name of the deceased were inadvertently omitted from the schedule of securities annexed to Testamentary Petition (L) NO. 1012 of 2007, and hence, the present Interim ---------------------------------------------------------------------------------------------------------------------------------------------------------------------------------

The Applicant is the daughter of the deceased and is entitled to claim a one-third share in the estate of the deceased. The other two legal heirs, being the sisters of the Applicant have given their respective consent to the reliefs sought in the present Interim Application, and the necessary Consent Affidavits have been duly placed on record. Considering this, the present Interim Application is disposed of in terms of the following order: :: ORDER ::

(i) Delay of 6436 days in filing the present Interim Application is hereby condoned and the Applicant is permitted to amend the schedule of securities which is annexed to Testamentary Petition (L) No. 1012 of 2007 in accordance with the draft Schedule of Amendment that is annexed as Exhibit 'C' to the present Interim Application. The Prothonotary and Senior Master of this Court is directed to accept the original Succession Certificate dated 6th May 2008 and to issue an amended certificate in terms of the amended schedule of securities.

(ii) This Amendment shall be carried out on or before 6th March 2026.

(iii) The Interim Application is disposed of in ---------------------------------------------------------------------------------------------------------------------------------------------------------------------------------

(iv) There shall be no order as to costs.
