INTERIM APPLICATION NO.852 OF 2025 AND INTERIM APPLICATION NO.853 OF 2025 1.
Both these Interim Applications, one filed by the Defendant no.5 and the other filed by the Defendant no.4, seek condonation of delay avk 1/3
respectively of seven days and four days in filing their written statements.

On 25th March 2025, Mr.Kotwal, learned Counsel appearing for the Plaintiff, had sought time to take instructions in the matter. Today when the matter is called out, Mr.Kotwal submits that he has instructions albeit without prejudice to the rights and contentions of the Plaintiff, to not object to the Interim Applications. 3.
Accordingly, having heard the learned Counsel and having perused the Interim Applications, the delay of seven days and four days respectively is condoned and the Interim Applications are allowed in terms of prayer clauses 8(a) and 8(b) which respectively read thus : INTERIM APPLICATION NO.852 OF 2025 (a) this Hon'ble Court be pleased to condone the delay of 7 days in filing the present Written Statement;
(b) this Hon'ble Court be pleased to take the Written Statement of the Applicant on record;
INTERIM APPLICATION NO.853 OF 2025 (a) this Hon'ble Court be pleased to condone the delay of 4 days in filing the present Written Statement;
(b) this Hon'ble Court be pleased to take the Written Statement of the Applicant on record;

Registry to accept the written statements of both the Defendants in the Suit. Let the same be served upon the Plaintiff within a period of two weeks.

The Interim Applications accordingly stand allowed and are disposed as above.
