The Interim Application seeks condonation of delay of 5 days in filing of the caveat and affidavit in support thereof. 2.
Learned Counsel appearing on behalf of the Applicant submits that a copy of this Interim Application has been served upon the Petitioner and undertakes to file affidavit of service in that regard in the Registry within a period of one week from today. Having due regard to the averments made in the Interim Application as also the fact that the delay is insignificant, the Interim Application deserves to be allowed. The Interim Application is thus allowed in terms of prayer clause (a), which reads thus: "a) This Hon'ble Court be pleased to condone the delay of about 5 days (as per uploading of Caveat and Affidavit- in-support thereof on 01.08.2024 by e-fling) in taking out this Application and be further pleased to taken on record the Caveat and the Affidavit-in-support thereof dated 24.07.2024 of the Applicant and treat the same as Applicant's Written Statement;" 4.
Registry to take on record the caveat as also affidavit in support thereof.
